Bank of America, National Association, Tokyo Branch (the “Branch”) will handle the joint use of personal data as follows:

Joint Use

The Branch will share personal data with the joint user pursuant to the provision of Article 23, paragraph (5), item (iii) as follows:

 

1. Joint Use of Dishonor Information

 

(1) Items of personal data to be used jointly

The Branch will jointly use the information on the drawer of dishonored bill or check (or acceptor of bills of exchange, the same shall apply hereinafter), and the client of current account  opening as follows;

(a) Name of the drawer (for a corporation,  corporate name, name and title of the representative)

(b) Trade name of the drawer if any

(c) Address (for a corporation, its location) (including the zip code)

(d) Name of the client opening a current account (for a corporation,  corporate name, name and title of the representative. trade name if any.)

(e) Date of Birth

(f) Occupation

(g) Capital (limited to a corporation)

(h) Type and nominal value of the relevant bill or check

(i) Distinction between a dishonored check notice (the first dishonor) and suspend transaction report (disposition to suspend transactions)

(j) Date of exchange (date of presentation)

(k) Paying Bank (including name of department and/or branch)

(l) Out-clearing Bank (including name of branch or department)

(m) Reason for dishonor

(o) Date of disposition to suspend transactions

(p) Clearing house in which the paying bank (branch) of the dishonored bill or check is participating and the bankers association of which the relevant clearing house hold a membership

(Note) In case where the information of above (a) to (c) described in the dishonored bill or check  is different from the information that has been filed with the paying bank, the information described in the  bill or check shall be included.

 

(2) Scope of joint users

(a) Local clearing houses

(b) Financial institutions participating in local clearing houses

(c) Personal Credit Information Center established and administrated by Japanese Bankers Association

(d) Each local bankers association which is a special member of Japanese Bankers Association (including Reference Center to Persons Whose Transactions Are Suspended of each local bankers association)

 

(3) Purpose of Use

Ensuring the smooth distribution of bills and checks and making decisions on their own credit transactions at financial institutions

 

(4) Name of Responsible Person for Personal Data Management

The Bankers Association which the clearing house is a member, where the paying bank of the dishonored bill and/or check belongs to

2. Joint use with Bank of America Group Companies

 

(1) Items of personal data used jointly

  • Name
  • Address
  • Telephone Number
  • Fax Number
  • Date of Birth
  • Occupation and Place of Work
  • Work E-mail Address
  • Account Number
  • Transaction Information
  • Account Number of Bank Transfer
  • Corporate Name
  • Location
  • Employment Management Information of Employees
  • Other information (including "sensitive information") to be acquired following the customer's consent and used to the extent required to secure transactions made in the ordinary course of the Branch's business

 

(2) Scope of joint users

A Bank of America group company

A Bank of America group company shall be an affiliate of Bank of America Corporation, the ultimate holding company of the Branch

 

(3) Purpose of use

The Branch and the joint user described in Section 2-(2) above will handle the personal data listed in Section 2-(1) above (within the scope of the Branch’s purpose of use of personal information – see Purposes of Use) in order to provide the best products and services, to process various transactions and/or to judge the suitability of products and services in light of the Branch’s general rules of adequacy, risk management, prevention of unfair trade, performance management, business analysis, labor management, etc.

4. The Chief Personal Data Officer will be responsible for managing the personal data listed in Section 2-(1) above.
